Disney有关SMAETA审核新政已开始实施

从2018年7月1日开始，对于当日之后执行的Sedex会员道德贸易审核(Smeta)，迪士尼接受由八间审核公司之一执行的该类型审核。此八间审核公司同时也是迪士尼制定的可执行迪士尼ILS标准审核的审核公司。除此以外，由其他任何审核公司执行的Smeta审核，无论其是否已符合Smeta的任何要求，迪士尼一律不予接受。

最近，还会有工厂问起，我们通过迪士尼验厂了，那我们的FAMA呢？青岛安德再次提醒大家：

1.通过了Disney的审核以及拿到审核报告的，并不能等同于有了FAMA.可是有了FAMA认证的一定是通过了disney审核。

2.工厂拿到了disney的通过报告，需由其授权商LiCEnsee，将其FAMA的申请表以及通过的disney报告一起提交给Disney进行审查，通过后才会给工厂签发FAMA.（注：授权商和工厂FAMA是一一对应的）

3.disney审核报告有效期1年，工厂要在快到期以前及时进行年审，以保证提供的最新审核报告支持FAMA的有效性。

关于FAMA证书

FAMA:FACILITYANDMERCHANDISEAUTHORIZATION即：经常我们所说的迪士尼的授权书。

FAMA用途：

处于全球反恐的考虑，美国不容许带有任何恐怖的国家和地区出口产品进美国的。而DISNEY总部就在美国，自然严格按照这一标准针对他们出口到世界各地的产品。

FAMA不仅在出口的情况下要提交给中国海关，以证明你的货是经DISNEY授权的，不仅工厂安全，产品也是安全的；此外目的港海关也必须FAMA，证明各方面安全的同时，也保证你的产品是合法途径进来的，而不是仿冒DISNEY的牌子。

有关DISNEY验厂与FAMA证书的问题答疑

出口企业申请迪士尼FAMA的前提条件是必须有Disney的Licensee，即授权商，授权商拥有某产品某区域的销售授权，其次授权商要做的就是将工厂的FAMA申请表及验厂报告提交给Disney，Disney审核通过后才会签署FAMA。工厂拿到FAMA之后才能够进行生产、海关备案、出货。

关于Disney审核、迪士尼授权（FAMA）、海关扣货等。总结了如下最普遍的六个问题及解决方案：

01：没有授权商Licensee，只做了Disney验厂，有验厂报告，能否生产？

-不能，由于没有Licensee，没人能帮忙提交报告到Disney,更不会拿到迪士尼签署的FAMA；

02：有验厂报告，也通过Licensee提交给Disney了，是不是就能够生产了？

-不能，Disney明确规定工厂在拿到FAMA以前不能够进行任何Disney产品生产。

03：验厂报告1年到期了，顾客还有Disney好像也没有通知要再验厂，是不是能不验了？

-不能，Disney明确规定现有工厂必须至少每隔12个月提交新的Disney验厂报告，才能够维持FAMA持续有效。

04：我现在有授权商A在合作，也有FAMA，马上有此外1个授权商B要合作，是不是能够直接合作？

-不能，FAMA都是Licensee与工厂一一对应，因此工厂若是有10个不同的Licensee，那么就必须10份对应的FAMA。若是验厂报告在1年的有效期之内，那BLicensee就必须跟Disney进行申请专属FAMA。

05：拿到了Disney的FAMA是不是能够做货、出货了？

-不能，必须进行Disney海关备案，联络Disney律师进行海关备案操作，完成后方可出货。

06：工厂几年前上了黑名单，但为何现在验厂报告很干净漂亮，Disney还是不给FAMA呢？

-上了Disney的黑名单，黑名单的期限是1年，到期后是能够进行验厂、重新恢复授权。可是工厂必须要走1个至关重要的流程：黑名单解禁，黑名单并不是满了1年之后就能够自动恢复。流程都没走就验厂，尽管拿到了一份看似漂亮、符合要求的报告，但不履行授权恢复的程序，不可能重新获得FAMA的。对于黑名单解禁的工厂，必须提供恢复授权的文件、同时再附带上Disney的验厂报告，两者缺一不可。
