案例简述

商标局对商标申请进行审查后，以申请的商标用于指定的服务项目，缺乏意义，不允许注册为商标为由，驳回了注册申请，违反了《商标法》第十一条第一款第(三)项的规定。2018年6月19日，申请人不服上述驳回决定，依法申请再审。

相关公众在申请商标时难以认定该商标为区分服务来源的标志，缺乏商标应当具备的显著特征，已经构成《商标法》第十一条第一款第(三)项规定的情形。因此，复审服务中的商标注册申请被驳回。
