案例概述

2015年，光明乳业提交争议商标注册申请，2016年8月获准注册。2018年8月，思联药业宣布争议商标无效，辩称争议商标与被引用商标构成类似商标，侵犯了其之前的商品名，容易引起消费者的混淆和误解。

TRAB裁定

1.争议商标的汉字部分包括被引用商标的汉字部分，指定商品功能和用途一致，容易造成混淆，构成近似商标。

2.部分无效裁定，咖啡、可可、乐口福、茶饮料等核心商品无效。

北京知识产权法院

维持商标评审委员会的裁决，驳回光明乳业的索赔。目前案件处于上诉期。

1.中国的商标按类别受到保护，并在第29类中注册保护，但在第30类中没有追溯保护。

2.对于已经设计具有较强意义、拟在市场上广泛投入的重要商标，企业在申请前应进行全面的标准化和布局，一方面保证品牌核心价值的稳定性，另一方面注意相关类别和防御类别的联动保护，避免出现大的漏洞，影响品牌运营。
