案件简要说明
2003年，中国人民大学申请学校校徽图案——三个平行篆书“人”字形作为商标，核心类别是41种教育培训。
2004年商标注册，独占期为2004年6月至2014年6月。
2014年，标志商标专用期限届满，令人惊讶的是，人民大学并未申请续展该商标，在六个月的展期后也未申请续展。因此，该商标因未被续展而无效。
2016年，泉州春晖迪达公司提交了一份与校徽图案高度相似的图形商标注册申请，类别为41，于2017年成功注册。
2017年，即商标未续展无效三年后，人民大学才发现商标未续展，再次申请注册。当然，由于春晖迪达公司已经先行注册，该商标被驳回，并被驳回复审，注册商标无效。
专业经验
1.商标专用权期限为十年，可以提前一年续展，期满后再延续半年。每次续展后，专有权增加十年。期满后确定继续使用的，必须在商标有效期内续展。
2.做好商标管理极其重要。如果商标因不续展而无效，很可能是被他人注册或者有类似商标。重新申请会更加困难，给企业造成严重损失。
