法院判决

1.本案审理时，被引用商标正在撤销审查过程中，仍处于合法有效状态，是在先壁垒商标。

2.商标驳回复审案件属于单方程序，被引用商标持有人不可能作为诉讼主体参与诉讼程序。因此，在缺乏充分证明和辩论的情况下，不能考虑商标受欢迎程度，否则是违背程序正当性的。所以原告的证据是单方证据，法院不予支持。

3.因此，原告主张被驳回，争议商标和被引用商标构成近似商标，诉讼失败。

专业经验

1.诉讼一般不等待被引用商标的撤回或复审结果的撤销。

2.目前法院不认可商标知名度的使用证据。理由是驳回复审是单方程序，证据未经质证辩论。另一方面，法院目前面临着巨大的审限压力，可以在不考虑争议商标的证明程度的情况下加快审查。

3.鉴于目前诉讼审查的现状，争取商标的原则是不中断原商标程序，新商标申请应连续提交。
