首先，博利谋控股公司提供的证据可以证明，通过其持续使用和广泛宣传，商标“博利谋”和“BELIMO”形成了一一对应关系。争议商标“博利谋”和被引用商标“BELIMO”构成类似商品上的近似商标。在上述商品上同时存在争议商标和被引用商标二，容易导致相关公众对商品原产地的混淆和误解，在上述商品上注册争议商标违反《商标法》第三十条的规定。

其次，商标“博利谋”是一个没有固定含义的虚词。博利谋阀门公司在申请商标纠纷时，在知道博利谋控股公司商标的情况下，有理由认定其存在抄袭、抄袭的主观恶意。是以“其他不正当手段”申请注册的案件，违反了《商标法》第四十四条第一款的规定。

综上所述，有争议的商标应当宣告无效。
