法院判决

1.一审法院和二审法院均裁定滴滴公司败诉。

2.北京市高级人民法院认为，被引用商标的注册人并未作为诉讼标的参与相关程序，仅根据滴滴公司提交的证据，尚不可能根据在先商标的在先使用或受欢迎程度来确定争议商标是否可识别，这可以与两个被引用商标区分开来。

专业经验

1.在驳回复审诉讼的情况下，法院不会考虑证据和争夺商标知名度的态度。驳回复审是单方面的程序，申请人提交的证据没有经过质证。如果通过，就违背了程序的合法性。

2.商标前期查询和专业分析很重要。目前商标审查的重点是相似性，所以无论一个商标申请人有多知名，只要构成商标相似性，在商标注册的道路上还是会“抛锚”。
