拒绝的原因

商标局决定

商标局认为申请商标缺乏意义。

TRAB裁定

商标评审委员会认为，申请商标中“russet”的中文含义为“auburn”，用于指定商品时无法起到识别商品原产地的作用，缺乏意义。

一审判决

申请商标“russet”有“auburn”的含义，但这个含义相对于国内相关公众来说比较少见，一般消费者并没有意识到它的颜色含义。此外，申请商标除“russet”一词外还有可识别的图形，因此申请商标具有商标显著性。命令TRAB做出新的裁决。
